Court To Review Right To Sue

The Supreme Court will decide this term whether a union can waive an employee's right to sue over issues such as bias in the workplace. The court heard arguments last week in a case that centers around whether a longshoreman -- whose union had agreed to submit all individual employment disputes to arbitration -- can file a bias suit under the Americans with Disabilities Act against seven shipping companies that refused to hire him after he was injured on the job in 1992. The lower courts have ruled in favor of the shipping companies.
