Lawsuit Protection

In a growing number of states, manufacturers no longer need to worry about being exposed to future federal lawsuits if they build on brownfield sites and comply with state cleanup rules. EPA has signed formal agreements with 13 states fully accepting their voluntary brownfield cleanup programs. In those states the agency won't exercise its right to overrule the state plans, which include protections against liability. The 13 states are: Colorado, Delaware, Illinois, Indiana, Maryland, Michigan, Minnesota, Missouri, New Mexico, Oklahoma, Rhode Island, Texas, and Wisconsin. --William H. Miller
